RENTAL TERMS AND CONDITIONS

Paying the payment request for the rental items associated with the attached pricing constitutes agreement to these rental terms and conditions. You are responsible for reading the entire terms and conditions. The following conditions and its terms will set forth an agreement between Let’s Celebrate Party Rental (provider) and Event host/client (Client), for item displayed on invoice and any other rentals stated in the notes area. These written terms and conditions set forth the full, written intention of the host/client.

1.SEVERABILITY

The provider of this rental contract shall be severed able so that the unenforceability or waiver of the provisions shall not affect the remaining provisions RESPONSIBILITY OF USE & DISCLAIMER OF WARRANTIES. You are responsible for the use of the rented items. You assume all risks inherent to the operation and use of rented items, and agree to assume the entire responsibility for the defense of, and to pay, indemnify and hold Let’s Celebrate Party Rental harmless from and hereby release Let’s Celebrate Party Rental from, and all claims for damage to property or bodily injury (including death) resulting from the use, operation or possession of the items, whether or not it be claimed or found that such damage or injury resulted in whole or part from Let’s Celebrate Party Rental negligence, from the defective condition of the items, or any other cause. YOU AGREE THAT NO WARRANTIES EXPRESSED OR IMPLIED, INCLUDING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE HAVE BEEN MADE IN CONNECTION WITH THE EQUIPMENT RENTED.

​​2.EQUIPMENT FAILURE

You agree to immediately discontinue the use of rented items should it at any time become unsafe or in a state of disrepair and will immediately (one hour or less) notify Let’s Celebrate Party Rental of the facts. Let’s Celebrate Party Rental agrees at our discretion to make the items operable within a reasonable time, or provide a like item if available, or make a like item available at another time, or adjust rental charges. The provision does not relieve the renter from the obligations of the contract. In all events, Let’s Celebrate Party Rental shall not be responsible for injury or damage resulting from failure or defect of rented items.

​​3.USE OF EQUIPMENT

Renter agrees & covenants to be satisfied with the instruction and condition of equipment rented and of the proper and safe use of equipment, or that renter is so familiar and conveyed to Let’s Celebrate Party Rental you were. Renter further agrees that the items will be used only at the address listed on the contract, and only for the purpose for which it was intended and manufactured. Subleasing or improper use is prohibited. Renter agrees they have read all instruction manuals, operating instructions and warnings related to rented items.

4.TIME OF RETURN

Renter’s right of possession terminates upon the expiration of the rental period set forth in the contract. Time is of the essence in this contract. Any extension must be agreed upon in writing.

5.LATE RETURNS

Renter shall return rented items to Let’s Celebrate Party Rental during regular business hours, promptly upon, or prior to the expiration of the rental period. If the renter does not timely return, the rental rate shall continue until items are returned.  If items are unreturned 5 days after the scheduled return time, replacement fees will be applied. These are the items and their estimated replacement fees.

  • 6ft Tables- $40/table
  • White plastic chairs- $15/chair more than

6.PAYMENT

Deposits: A 30% non-refundable deposit guarantees your reservation. Deposits secure the availability of the rental items. Regardless of the reason for cancellation, deposits cannot be refunded.

FULL PAYMENT is due 1 day in advance of your event date or delivery/customer pick-up. We accept Cash, Credit Card and Zelle.

If this obligation is not met, Let’s Celebrate Party Rental reserves the right to cancel the order without refunding the initial 30% deposit.​​

7.DELIVERY

The delivery rate is $100 within a 40 miles radius of Desoto in the DFW metroplex.

Delivery/customer pick-up hours:

Mon-Fri- 6pm -8pm

Sat – 9am-5pm

Sun- Appointment only

Let’s Celebrate Party Rental will make its best effort to deliver at requested delivery times, however delivery schedules are not guaranteed in the event of traffic, weather, workload and other circumstances beyond the control of the driver.

Count all items with the driver and sign the delivery invoice when you are sure everything has been delivered. We cannot accept quantity disputes after the event. If you do not arrange to have someone on site at the time of delivery, our driver will leave your rental items at a predetermined location. In this case, you agree to accept the order as complete and all delivered items are in good working order, unless we receive a phone call or time dated email prior to the event.

Client assumes all risk of damage or injury during installation of rental items. This includes damage to hardwood, tile, stone flooring, patios, tennis courts, driveways, walkways and underground utilities.

Deliveries are made to an area readily accessible to our trucks/trailers. Residential deliveries and pickups are only made to drive-way. An extra fee of $100 will apply for difficult access, long carries, backyard deliveries, stair or elevator deliveries, repeated delivery or pick-up attempts.

NOTE: We do not set up or take down the table and chairs. They will be delivered folded and stacked. At pick up, they should be ready – folded and stacked.

8.CARE OF EQUIPMENT

Rental items remain the responsibility of the customer from the time of delivery/customer pick-up to the time of its return. Protect the rented items from weather damage, breakage, unauthorized or improper use, theft or loss while in the possession of the renter.

STORAGE: Store all rental items in an area protected from theft, vandalism or weather.

​​9.HOLD HARMLESS AGREEMENT

Renter agrees to assume all risk and agrees to hold Let’s Celebrate Party Rental and any of its staff harmless from and against any and all claims, losses, liabilities, and damage, and all costs and expenses arising directly and indirectly at of or relating to:

  • The delivery, loading, unloading, erection, installation, dismantling, and use of rented equipment
  • Contact of underground utilities, pipes, or any condition on renter’s property
  • All necessary surface repairs

10.PRICING

Pricing is subject to change without notice. Prices represented on the price list represent a one-day rental period, which includes customer pick-up/delivery the day before the event, keeping the items for the day of the rental, and customer return/pick-up on the day after the event. 11.CANCELLATION POLICY

Cancellation: If you decide to cancel your rental, we do not issue refunds for any reason. However, we offer a rain-check option to hold your funds for future use.

The following conditions apply:

Raincheck: Instead of a refund, we will hold the funds you paid as a raincheck. This raincheck is valid for 6 months from the original event date, starting from the day after your original event date. You can utilize the rain-check amount towards any future rental with us during this 6-month period. The raincheck is non-transferable and can only be used by the individual or organization that made the original reservation.

Weather-Related Cancellations: If weather conditions prohibit the installation of the rented items, we do not issue refunds. However, we offer the rain-check option as mentioned above. We understand that uncontrollable circumstances like severe weather can arise, and we will do our best to accommodate your needs within the validity period of the raincheck.

Customers who cancel their orders at any time after a deposit is provided WILL LOSE THEIR DEPOSIT regardless of their circumstances or reasons for cancellation.

Rebooking: If you wish to reschedule your rental to a different date within the 6-month rain-check validity period, please contact us as soon as possible. We will make every effort to accommodate your request, subject to the rental item availability.

No refunds will be issued on unused items. All rental items are subject to availability at time of booking. Prices are subject to change without notice. Website prices represent current pricing.

12.CUSTOMER PICK-UP / RETURNS

Customers may pick up most items from the Let’s Celebrate Party Rental during normal business hours, if they wish to avoid delivery and pick-up charges. Please clean out all debris from truck/trailer prior to hauling equipment. Let’s Celebrate Party Rental is not responsible for any damages occurring to the vehicle during loading/unloading of items. All items are to be returned on the date listed on the invoice. If late, additional rental charges apply.

​​13.RETURNS – FINAL INSPECTION

Let’s Celebrate Party Rental reserves the right to modify charges for broken, missing, damaged, or dirty items up to 7 days after items have been received prior to going through FINAL inspection.

14.PRIOR TO PICK-UP OR RETURN

Rental Items including Tables and Chairs should be stacked in the same manner they were upon delivery. Additional charges may apply if restacking of items is necessary. Customer will pay the full replacement cost for any rental items missing upon pick-up.

​15.EQUIPMENT RESPONSIBILITY

All items are to be inspected by the customer at time of drop off. If there are problems with items, Let’s Celebrate Party Rental must be notified before the event. Renter is responsible for equipment from time of possession to time of return. Renter assumes the entire risk of loss, regardless of cause. If items are lost, stolen, or damaged, the renter will assume all costs of replacement or repair, including all labor costs.Any items not wanted upon delivery are still to be paid for by the customer.

16.EMERGENCY LINE

If renter does not attempt to contact Let’s Celebrate Party Rental directly after he/she has had a problem with a rental item, no refund, discount etc., will be given, NO EXCEPTIONS.​
